Caldwell & Watson’s Defense of Will Affirmed by Georgia Supreme Court
March 21, 2011

Attorneys Floyd E. Propst, Wade H. Watson III and Laura K. Bonander successfully defended the probate of the Last Will & Testament of Margaret Susan Scheer on behalf of the Executors of the Estate. The will had been challenged by a grandson of Ms. Scheer, but the probate court granted the Executors’ motion to dismiss the caveat on the grounds that the grandson was not an heir at law and lacked standing.Wade Watson argued the case for the Executors in the Georgia Supreme Court on February 14, 2011. In a unanimous opinion, the Georgia Supreme Court affirmed. The Court observed that because the grandson would only benefit from the probate of the will rather than be harmed by it, he lacked standing to file a caveat challenging it. The case is styled Norman v. Gober et al. NO. S11A0024 (March 7, 2011).
